Terms of Service
1. Acceptance of Terms
By downloading, installing, or using the Simmer mobile application ("Simmer," "the App," or "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.
Simmer is licensed to you under the Apple Standard End User License Agreement (EULA), available at apple.com/legal/internet-services/itunes/dev/stdeula. These Terms supplement the Apple EULA. In the event of a conflict between these Terms and the Apple EULA, the Apple EULA shall prevail to the extent of the conflict.
These Terms constitute a legal agreement between you ("User," "you," or "your") and:

2. Service Description
Simmer is a mobile application that transforms recipe URLs into step-by-step cooking guides with timers, precise metric weights, and intelligent step resequencing. The App uses artificial intelligence to parse and reformat recipe content from external websites.
2.1. AI-Powered Parsing. Recipe parsing is performed by AI models. While we strive for accuracy, AI outputs are generated automatically and may contain errors. No guarantee of accuracy, completeness, or suitability is provided for any AI-generated content.
2.2. Third-Party Dependencies. The Service relies on third-party APIs and infrastructure, including but not limited to cloud hosting, AI model providers, and payment processors. The availability of Simmer depends on the availability of these third-party services. We do not guarantee uninterrupted or error-free operation of the Service.
2.3. Availability. The App is currently available on iOS via the Apple App Store. Availability on other platforms may be offered in the future at our sole discretion.
3. Device-Based Identity
3.1. No User Accounts. Simmer does not require user accounts, email addresses, or passwords. Your identity within the App is tied to a unique device identifier (UUID) stored securely in the iOS Keychain.
3.2. Device Loss. If you lose access to your device, you will lose access to any locally stored data, including saved recipes and cooking session progress. Simmer is not responsible for data loss resulting from device loss, damage, or reset.
3.3. Restore Purchases. If you change devices, you may restore any active subscriptions using the "Restore Purchases" feature in the App, which is linked to your Apple ID rather than your device identifier.
4. Free Tier and Rate Limiting
4.1. Free Tier. Simmer offers a free tier that includes 3 welcome recipes upon first use and 1 recipe parse per day thereafter.
4.2. Rate Limits. Rate limits are enforced both on the device and on our servers to ensure fair usage for all users.
4.3. Prohibited Circumvention. You may not attempt to circumvent, bypass, or manipulate the rate limiting system. Prohibited activities include, but are not limited to:
- Sending automated or scripted requests to the Service
- Manipulating, spoofing, or resetting your device identifier
- Using multiple devices or emulators to exceed rate limits
- Exploiting bugs or vulnerabilities to obtain additional parses
Violation of this section may result in immediate suspension of access to the Service.
5. Subscriptions (Simmer+)
5.1. Subscription Plans. Simmer offers a premium subscription ("Simmer+") with the following plan options:
- Weekly subscription
- Monthly subscription
- Annual subscription
Current pricing is displayed in the App and on the App Store product page.
5.2. Free Trial. A 7-day free trial may be available for eligible users. If you do not cancel before the end of the trial period, your subscription will automatically convert to a paid subscription at the applicable rate.
5.3. Payment. All payments are processed by Apple through the App Store. Simmer does not directly collect or store any payment information.
5.4. Auto-Renewal. Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
5.5. Cancellation. You may cancel your subscription at any time through your iOS device: Settings > [your name] > Subscriptions > Simmer+. Cancellation takes effect at the end of the current billing period. You will retain access to Simmer+ features until the end of the period you have already paid for.
5.6. Refunds. Refunds are handled by Apple in accordance with Apple's refund policies. You may request a refund through Apple's support channels. Additionally, consumers in the European Union retain all refund rights afforded by applicable EU consumer protection laws.
5.7. Pro Features. Simmer+ includes, subject to change:
- Unlimited recipe parsing (no daily rate limit)
- Video recipe support (TikTok, YouTube, Instagram)
- Premium AI model for higher parsing accuracy
6. Third-Party Content
6.1. Recipe Sources. Simmer parses recipes from external, third-party websites. The original recipe content, text, images, and media remain the property of their respective owners.
6.2. No Ownership Claim. Simmer does not claim ownership of any original recipe content sourced from third-party websites.
6.3. Personal Use Only. Parsed recipes are provided for your personal, non-commercial use only. You may not redistribute, republish, or commercially exploit parsed recipe content obtained through the Service.
7. AI Disclaimer
7.1. No Guarantee of Accuracy. The AI-powered recipe parsing feature may produce errors, including but not limited to inaccuracies in:
- Ingredient quantities and measurements
- Metric conversions (e.g., cups to grams)
- Cooking steps and their sequence
- Temperatures and cooking times
- Timer durations
- Equipment recommendations
7.2. User Responsibility. You MUST independently verify all AI-parsed information before and during cooking. You are solely responsible for reviewing ingredient amounts, temperatures, cooking times, and all other details for accuracy and safety.
7.3. No Liability for Cooking Outcomes. Simmer is NOT liable for any of the following arising from the use of AI-parsed recipes:
- Unsatisfactory cooking outcomes
- Food safety issues, including foodborne illness
- Allergic reactions or adverse health effects
- Personal injury or burns
- Property damage, including fire or equipment damage
- Any other loss or damage related to cooking
7.4. Allergen Warning. AI parsing may fail to identify or correctly list allergens present in a recipe. If you have food allergies or dietary restrictions, you must consult the original recipe source and verify all ingredients independently.
8. Acceptable Use
You agree to use Simmer only for its intended purpose: personal recipe parsing and cooking assistance. The following activities are strictly prohibited:
8.1. Scraping and Automation. Using bots, scrapers, crawlers, or any automated means to access the Service or extract data from it.
8.2. Rate Limit Circumvention. Any attempt to bypass, circumvent, or manipulate the rate limiting mechanisms described in Section 4.
8.3. Reverse Engineering. Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code of the App or its AI parsing technology.
8.4. Commercial Exploitation. Aggregating, reselling, or commercially distributing parsed recipes or any data obtained through the Service.
8.5. Competitive Use. Using the Service, its outputs, or its technology to build, train, or improve a competing product or service.
8.6. Harmful Use. Using the Service in any manner that is unlawful, harmful, fraudulent, or that infringes on the rights of others.
9. Intellectual Property
9.1. Simmer's Property. The Simmer application, its branding, logos, user interface, AI parsing technology, and all related intellectual property are owned by Lumon Spark Artur Lamali. All rights not expressly granted in these Terms are reserved.
9.2. User Content. You retain all rights to your saved recipes, notes, and any content you create within the App.
9.3. Original Recipe Content. Original recipe content sourced from third-party websites remains the intellectual property of the respective website owners and content creators.
10. Limitation of Liability
10.1. "As Is" Provision. The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10.2. Liability Cap. To the maximum extent permitted by applicable law, the total aggregate liability of Lumon Spark Artur Lamali arising out of or in connection with these Terms or your use of the Service shall not exceed the total amount you have paid for the Service in the twelve (12) months preceding the event giving rise to the claim.
10.3. Exclusion of Certain Damages. To the maximum extent permitted by applicable law, Lumon Spark Artur Lamali shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill.
10.4. Mandatory Consumer Protections. Nothing in these Terms shall limit liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for gross negligence or willful misconduct, or for any other liability that cannot be excluded or limited under applicable law, including Polish law and EU consumer protection regulations.
11. Termination
11.1. Suspension by Simmer. Simmer reserves the right to suspend or terminate your access to the Service, without prior notice, if you violate these Terms or engage in conduct that we reasonably believe is harmful to the Service, other users, or third parties.
11.2. Termination by User. You may stop using the App at any time by deleting it from your device. No notice to Simmer is required.
11.3. Effect of Termination. Upon termination of your access:
- Any locally stored data (saved recipes, cooking sessions) remains on your device unless you delete the App.
- Server-side data associated with your device identifier will be deleted in accordance with our data retention policy.
- Active subscriptions must be cancelled separately through iOS Settings to prevent further charges.
12. Governing Law and Dispute Resolution
12.1. Governing Law. These Terms shall be governed by and construed in accordance with the laws of the Republic of Poland, without regard to its conflict of law provisions.
12.2. Jurisdiction. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Warsaw, Poland.
12.3. EU Consumer Rights. If you are a consumer residing in the European Union, you retain the right to bring proceedings in the courts of your country of residence, in accordance with applicable EU consumer protection regulations. Nothing in these Terms affects your statutory rights as an EU consumer.
12.4. Online Dispute Resolution. The European Commission provides an Online Dispute Resolution (ODR) platform for EU consumers, available at: ec.europa.eu/consumers/odr
13. Changes to Terms
13.1. Modifications. Simmer reserves the right to modify these Terms at any time. Updated Terms will be posted within the App and will indicate the revised "Last Updated" date.
13.2. Notification. We will notify users of material changes to these Terms via an in-app notice.
13.3. Acceptance. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree with the revised Terms, you must stop using the Service.
